<p>Many of you might already know that the 3.21 firmware update for Sony&rsquo;s PlayStation 3 <a href="http://www.ubergizmo.com/15/archives/2010/03/ps3_321_firmware_to_disable_linux_support_for_older_models.html" target="_blank">disables the OtherOS functionality from the console</a>, which effectively means that you can&rsquo;t install Linux on it anymore. While hackers have been busy <a href="http://www.ubergizmo.com/15/archives/2010/03/geohot_looks_to_enable_other_os_support_for_the_ps3_321_firmware.html" target="_blank">enabling the feature</a> back on the console, some consumers think it&rsquo;s better to file a class action lawsuit against the company, as in the case of Anthony Venture who has <a href="http://www.geek.com/articles/games/ps3-otheros-class-action-lawsuit-filed-in-the-us-20100429/" target="_blank">done just that</a>. The lawsuit covers all PS3 consoles purchased from November 17th 2006 to March 27th 2010. The lawsuit calls for compensatory damages, restitution, injunctive relief and legal fees to be paid by Sony, and a figure of $5 million has been mentioned. <p>The law firm of Howard G Smith has today confirmed that it is in the midst of investigating the possibility of a class-action lawsuit being filed against Palm for potentially short-changing investors when it agreed to be <a href="http://www.ubergizmo.com/15/archives/2010/04/hp_buys_palm_acquires_key_smartphone_technology.html" target="_blank">purchased by HP</a>. They claim that Palm may have broken its fiduciary duty by agreeing to the alleged low price of $5.70 per share (totaling $1.2 billion) when it was worth as much as $17.20 last year. It&rsquo;s currently unclear how close the firm is to actually suing Palm or how successful such a case would be. What most public do know is that Palm was going through some pretty solid times before it was acquired, and might not have lived to see the future whether something wasn&rsquo;t done quick.</p>

The class action lawsuit claims that Apple&rsquo;s iPod can cause hearing loss, but the claim was rejected in the appeals court, and ruled that the plaintiffs did not adequately show that the use of the iPod &ldquo;poses an unreasonable risk of noise-induced hearing loss&rdquo;. Do you think that the iPods might cause you hearing loss? Wouldn&rsquo;t you just turn down the volume on your iPod whether the music was too loud anyways?</p>

<p>If there were about 1 million angry gamers who might want to sue you, most folks would be running and screaming for their mommy, but not Microsoft. Despite the possibility of facing a class-action lawsuit, a Redmond spokesperson has stressed that Microsoft is well within its legal rights to ban users from the Xbox Live as modifying an Xbox 360 is apparently a violation of the Xbox Live Terms of Use. Regardless of whether it&rsquo;s legally right or wrong, Microsoft isn&rsquo;t scoring any brownie points with gamers at the moment.
